As mandated by the Federal Labor Law (“FLL”), employees shall participate in the profits of the businesses they work for in accordance with a percentage determined by the National Commission for the Participation of Workers in Companies’ Profits. Said percentage of share participation may be revised every ten years, in accordance with the procedure established in the FLL.
To such effect, the First Session of the Workers and Employers Council of the Sixth National Commission for the Participation of Workers in Companies’ Profits took place on September 9, 2020, after union organizations requested – since April 2019- the revision of such percentage, equivalent to ten percent (10%) of the taxable income. This percentage was previously determined by the Fifth National Commission for the Participation of Workers in Companies’ Profits and published in the Federal Official Gazette (“DOF” for its acronym in Spanish) on February 3, 2009. We note that this percentage has not been increased since 1985.
