General Declaration of Unconstitutionality for the absolute prohibition of recreational use of cannabis

On Monday, June 28, 2021, the Supreme Court of Justice (“SCJ”) decided the general declaration of unconstitutionality 1/2018 (“GDU”), through which articles 235, last paragraph, and 247, last paragraph, of the General Health Law (“GHL”) were revoked.

The GDU procedure obliged the legislative branch to modify the GHL within 90-day period, which has been extended three times; as up to today the Mexican Congress has not complied with its amending obligation.
