Questionnaire issued by the Federal Economic Competition Commission on the market for Clean Energy Certificates

Dear clients and friends:
A brief note to remind you that the process to answer the questionnaire issued by the Federal Economic Competition Commission (“COFECE” or “Commission”) on the market for Clean Energy Certificates (“CELs”) is still open to the public.

The Energy Transition Law (“ETL”) indicates that two years after the CELs obligations come into force, the Commission is obliged to carry out an evaluation of the competitiveness of this market and, where appropriate, the emission of recommendations that improve their performance.


In this regard, COFECE invites decision-makers from the electricity sector, public institutions, the Union powers, users and permit holders, civil society organizations, business chambers and all interested persons, to answer the questionnaire open to the public on the Document relative to the CELs market.

The questionnaire is available and can be answered online, on the following website:
https://www.cofece.mx/cuestionariocel/

The questionnaire consists of 9 questions associated, among others, to question the efficiency of the existing regulation, as well as additional factors that facilitate or hinder its exchange in the market and the impact of cancellation of long-term electricity auctions. Those who answer the questionnaire also have the right to attach the documents and evidence of their answers that they deem appropriate.

Despite the health contingency and the agreements that both the COFECE and the federal authorities have issued in this regard, recent reports through its website have clarified that the Commission considers that the contingency doesn’t impact the possibility that participants won’t be able to answer the questionnaire in the originally planned calendar, so the participants only have until the last day of April of this year to answer it.
