On May 31, 2021, the Second District Court for Administrative Matters Specialized in Economic Competition, Broadcasting and Telecommunications, with residence in Mexico City and Jurisdiction throughout the Republic, granted to a plaintiff in an amparo process the provisional suspension of (i) the “Decree by means of which the Thirteenth Transitory Article of the Hydrocarbons Law, published in the Federal Official Gazette on August 11, 2014, is amended” (Decreto por el que se reforma el Artículo Décimo Tercero Transitorio de la Ley de Hidrocarburos, publicada en el Diario Oficial de la Federación el 11 de agosto de 2014), published in the Federal Official Gazette (“DOF”) on May 19, 2021 (the “Decree”)1 and (ii) the Decree A/015/2021, published in the DOF on May 21, 2021 by the Mexican Energy Regulatory Commission (Comisión Reguladora de Energía) (“CRE”), which repealed all provisions, guidelines, administrative provisions, resolutions and any other administrative actions that established the asymmetrical regulation over Petróleos Mexicanos (“PEMEX”) (the “Suspension”). It is important to note that the referred Suspension was granted with general effects, thus such instruments may not be applied against any company.
