Shielding Constitutional Amendments: New Provisions on Immunity from Judicial Challenge

On October 31, 2024, the “Decree Amending Articles 105 and 107 of the Political Constitution of the United Mexican States, Regarding Immunity from Challenge for Additions or Amendments to the Federal Constitution” (the “Decree”) was published in the afternoon edition of the Federal Official Gazette (Diario Oficial de la Federación). This Decree establishes that amendments to the Mexican Constitution are immune from judicial review.
