Decree adding article 216 Bis to the General Health Law

On March 24, 2023, the Federal Government published a Decree adding article 216 Bis to the General Health Law (the “Decree”).

This article forbids the use of trans fats (partially hydrogenated oils) throughout the manufacturing process of oils, edible fats, foods, and non-alcoholic beverages (the “Products”) which final presentation will be available to the public.

It also prohibits that the trans-fatty acids of industrial production of the Products exceed two parts per hundred of the total amount of acids contained thereunder.


The Ministry of Health (Secretaría de Salud) will issue the regulations of the trans-fatty acids of industrial production in the aforementioned terms.

Finally, these provisions will become effective 180 calendar days after the date of publication of the Decree (i.e., mid-September 2023) and it is expected that after the publication of this Decree other amendments to secondary regulations will follow (in order to ensure an adequate application of this new provisions).
