Antitrust and Telecommunications: Transition from Independent Regulators and Enforcers to Agencies within the Executive

As discussed in prior memoranda, in February of this year, the then-head of the Executive branch submitted to Congress a Bill of constitutional amendments to simplify the organization of Government (the “Bill”). Among other proposals, it suggested the dissolution of the Federal Competition Commission (“COFECE”) and the Federal Telecommunications Institute (“IFT”). Under the Bill, responsibility for enforcing competition laws across all industries and markets would be transferred to the Federal Executive, through one or more agencies responsible for general policies on industry, foreign and domestic trade, supply, and pricing (likely the Ministry of Economy) and telecommunications and broadcasting policies (likely the Digital Transformation and Telecommunications Agency (the “Agency”), whose creation was proposed on November 1st). This Agency would also assume IFT’s regulatory powers in the telecommunications and broadcasting sectors.
